It needs more than just that, at the moment you can call yourself an umbrella company but really just do whatever you want, and some of the companies out there do just that, until someone actually starts prosecuting or legally defines an umbrella company (a politically very unpopular idea despite the benefits it could bring about) there will be problems.

And dispensations shouldn't make a blind bit of difference if people are playing by the rules, I think we may be seeing those disappearing in the future as HMRC starts doing expense audits. It would be a potentially very easy way of wiping out non-compliant companies.

In many eyes our "industry" is small beer and any legislation has to be addressed across all employers. As in in the view of HMRC the minute you prescribe a method - clever people will work out a way around it.
