Blimey, it was such as busy day yesterday I almost missed this feature from Bel.

From my experience, it's quite frightening just how many agencies are ignorant to a true 'IR35 friendly' contract. That goes for the upper as well as the lower contract. Lurch’s advice has never been more on the money….”check your contracts” – it’s your responsibility, nobody else’s.

I've never had any of my contracts reviewed but I probably will going forward. Does anyone have any recommendations? I'm not sure if my accountant does this type of thing - he's pretty clued up on employment status but has never once mentioned the importance of the services contract. Any help would be much appreciated.

I can personally recommend Qdos, but there are others that are equally good (Bauer and Cottrell are recommended too). Qdos also offer a 'freelance club' for a fixed small annual fee that includes 3 reviews per year and an advice line for any follow up enquiries. These provide less thorough reviews, but are perfectly adequate if you've already negotiated IR35 compliant terms. A more comprehensive review, that starts from scratch, from any supplier normally costs over £100. But still cheap at the price.

Perhaps Seb can elaborate?

It's simple, really There are two flavours only:

A Contract of Service - you are there to provide a service personally to your hirer. The phrase comes from the original concept of Master/Servant.

A Contract for Services - you (or your representative) are there to deliver one or more defined services for a set fee.

Guess which one is outside IR35.

As Bel says, we do the Freelance Club for £40 + VAT or full reviews at £85 + VAT. Freelance Club provides 3 contract assessments per annum (pass or fail opinion + list of amendments), whereas the full review is a clause by clause analysis and working practices report.

Lots of other companies provide a similar service. When choosing which to use I think the most important thing is to ensure they've had experience in dealing with (and hopefully winning) IR35 enquiries. People often think IR35 reviews should be carried out by lawyers, but that's not normally the case.
