I've never seen an upper level contract although I may start asking to see it from now on. Perhaps we should ask the Mod to include this as an 'expert' question. “Am I legally entitled to see the agency / client contract?”

Now you're on the subject of contracts, I have often wondered whether or not to submit mine (before the start of an assignment) to HMRC. I know Hector provides a FOC contract review service but I am, for obviously reasons, dubious as to their motives for providing such as service.

What are your thoughts on this Seb

We would never, ever advise anyone to send their contracts to HMRC. The chances of a balanced, unbiased opinion are slim and a contract they said was caught could quite easily end up on the recieving end of an enquiry.

It's effectively a trap and, although I have spoken to a couple of fortunate people who have had received a 'pass', I think it's a highly inadvisable route to take.

Basically most things like this involving HMRC should be viewed with handfuls of cynicism and suspicion.

Blimey, that bad eh?

I do find it absolutely incredible that the government have implemented such an ambiguous and clearly unworkable piece of tax law. I only hope they see sense and do the right thing on Wednesday.

I genuinely am quite positive about this afternoon's budget. Maybe I’m a bit naive, but I do think there's a strong chance that IR35 could be gone (in some form) by the start of the next tax year. Roll on Mr Darling...
