Although they had received advice from Queen's Counsel that they had a strong case, it was impractical to put together all the case information before Monday's deadline.
The ARC had the support of its members and other interested parties within the industry but the REC and APSCo did not support the initiative.
The Agency Workers Regulations have been under discussion for 2 years and there have been 2 consultations. The regulations have now been written into law and the only way for the issue to have been kept open was by a judicial review.
Adrian Marlowe, the chairman of the ARC, said that time had defeated them. He believes that the recruitment industry needs to stick together to find ways to help employers with the worst excesses of the directive.
The REC's external relations director, Tom Hadley, said that whilst the call for a judicial review made headline grabbing news it had no chance of succeeding.
